Article 1 - Object 

These terms of sales are intented to define the contractual relations between Hot Race and the buyer and the conditions applicable to any purchase through the website www.hotracetyres.eu.

The acquisition of a product though the site implies unreserved acceptance by the buyer of these terms of sales which the bouyer acknowledges having read before ordering. 

Before any transaction, the buyer declares on the one hand that the purchase of products on the website www.hotracetyres.eu is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit under these general terms of sales. 

The Hot Race company retains the possibility of modifying these terms of sales at any time, in order the comply with any new regulations or in order to improve the use of its site. Therefore, the applicable terms will be those in force on the date of the order by the buyer. 

Article 2 - Products

The products offered are those which appear on the website www.hotracetyres.eu of the company Hot Race, within the limits of available stocks.

The Hot Race company reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics. The sale of the products presented on the site www.hotracetyres.eu is intented for all buyers resident in countries which fully authorize the entry into their territory of these products.

Article 3 - Order and payment methods

Before any order, the buyer must create an account on the site wwww.hotracetyres.eu. The account creation section is accessible above the horizontal menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile...) must identify himself. 

Article 4 - Price

For customers, the prices appearing on the product sheets of the internet catalog are prices in € (euros) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the rate of VAT may be reflected in the price of the products.

For professionals, the price appearing on the product sheets of the internet catalog are prices in € (euros) excluding taxes (HT). 

The Hot Race company reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order and the type of transport chosen.

Article 5 - Ownership

The Hot Race company retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included. 

Article 6 - Retraction 

Under article L121-20 of the Consumer Code, the buyer has a period of 14 days from delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for return costs.

Article 7 - Responsability

The Hot Race company, in the internet selling process, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the internet, such as loss of data, intrusion, virus, break in service, or other involuntary problems. 

Article 8 - Guarantee

The Consumer Code (Legislative Decree no. 206/2005) in Articles 128-135 provides the obligation for HOT RACE to guarantee consumers the conformity of the purchased good with the characteristics and qualities offered. Hot Race is therefore responsible for any lack of conformity existing at the time of delivery of the goods for all products sold in its shop.

In the event of non-conformity of a product sold, it may be returned to Hot Race, which will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made via the contact form within 30 days after delivery.

Article 9 - Delivery

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders will be shipped by the carrier selected at the time of confirmation of the order.

The different means of transport and the indicative delivery times are available on the "....." page. Hot Race can provide the buyer with a tracking number for their package by e-mail.

Transport risks are the responsability of the purchaser from the moment the items leaves the premises of Hot Race. The buyer is required to check in the presence of the attendant the condition of the packaging of the goods and its content on delivery. In case of damage during transport, it is advisable to refuse the package and notify the Hot Race company as soon as possible. The Hot Race company can't be held responsible for products damaged or lost during transport. 

Article 10 - Intellectual property

All elements of the website www.hotracetyres.eu are and remain the intellectual and exclusive property of the Hot Race company. No one is authorized to reproduce, exploit, or use for any reason whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text. 

Article 11 - Personal Data

The Hot Race company undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services.

All information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him. He can request it at any time by mail to the following address : contact@hotracetyres.eu
